WORKEARLY NETWORK TERMS
These WORKEARLY Network Terms govern participation in and interaction with certain professional networking and career-related features and services offered through the WORKEARLY network, including participation as a Mentor, participation as a Hiring Partner, and registration with the WORKEARLY Talent Pool.
The specific terms applicable to each category are set out in the relevant section below. Depending on the capacity in which an individual or organisation participates in the WORKEARLY network, only the relevant section or sections of these Network Terms will apply.
These Network Terms form an integral part of WORKEARLY’s overall Terms and Conditions and apply in addition to WORKEARLY’s Website Terms of Use, which apply generally and supplement these Network Terms. They should also be read together with WORKEARLY’s Privacy Policy and Cookie Policy, where applicable.
In the event of any conflict between these Network Terms and the Website Terms of Use or any other general terms, these Network Terms shall prevail solely in relation to the relevant WORKEARLY network feature or service. Any matter not specifically regulated by these Network Terms shall remain subject to the Website Terms of Use and any other applicable terms.
These Network Terms are organised as follows:
Part A — Mentors
Part B — Hiring Partners
Part C — WORKEARLY Talent Pool
PART A — MENTORS
PUBLICATION OF MENTOR PROFILE
Mentors agree to the publication of their photograph, name and a short professional biography on the WORKEARLY Website.
Mentors may request the removal or amendment of this information by contacting WORKEARLY. Where the publication of such information is based on the Mentor’s consent and that consent is withdrawn, WORKEARLY will remove the relevant information.
WORKEARLY may also remove or replace a Mentor’s profile or information from the Website at any time where WORKEARLY decides that the Mentor should no longer be featured on the Website.
Any views, opinions or statements expressed by Mentors are their own and do not represent or bind WORKEARLY.
OBLIGATION TO PROVIDE ACCURATE INFORMATION
Mentors must provide accurate and truthful information regarding their professional qualifications, experience and the guidance they provide.
WORKEARLY is not responsible for inaccurate or misleading information provided by a Mentor.
INDEPENDENT RELATIONSHIP WITH WORKEARLY
Participation as a Mentor in the WORKEARLY network does not create an employment relationship, partnership, agency or other relationship of dependent employment between the Mentor and WORKEARLY, unless expressly agreed otherwise in writing.
Mentors are not entitled to claim any fees, compensation or other financial benefit from WORKEARLY solely as a result of their participation in the WORKEARLY network, unless otherwise provided in a separate agreement between WORKEARLY and the relevant Mentor.
RESTRICTIONS & LIABILITY
WORKEARLY is not responsible for advice, guidance, views or opinions expressed or provided by Mentors in connection with their participation in the WORKEARLY network.
Mentors must comply with these Network Terms and any other WORKEARLY terms applicable to their use of the Website and relevant WORKEARLY services.
PART B — HIRING PARTNERS
Hiring Partners are companies and other organisations that participate in the WORKEARLY network for the purpose of promoting employment opportunities and connecting with potential candidates. Their participation in the WORKEARLY network is subject to the following specific terms.
ACCESS TO CANDIDATE INFORMATION & PROMOTION OF JOB OPPORTUNITIES
Hiring Partners may receive candidate CVs and other relevant candidate information:
directly from candidates, where candidates choose to submit an application through WORKEARLY’s available tools or services; or
through WORKEARLY, where the relevant candidate has authorised the sharing of their information with the specific Hiring Partner or where such sharing is permitted in connection with the candidate’s participation in the WORKEARLY Talent Pool, in accordance with the applicable terms and privacy information.
Hiring Partners may also have their open job opportunities promoted through WORKEARLY, where this forms part of the relevant arrangement with WORKEARLY.
Unless expressly agreed otherwise, WORKEARLY does not guarantee any minimum number of applications, candidate referrals, interviews or successful hires through its Website, network or services.
USE OF HIRING PARTNER NAME & LOGO
By participating in the WORKEARLY network, the Hiring Partner grants WORKEARLY a non-exclusive licence to use its company name, trade name and logo for the purposes of:
identifying and presenting the Hiring Partner as a participating company within the WORKEARLY network; and
promoting the Hiring Partner’s open job opportunities through WORKEARLY, where applicable.
The Hiring Partner’s name and logo will be used solely in connection with its participation in the WORKEARLY network and for the purposes described above, unless otherwise agreed in writing.
INDEPENDENT RELATIONSHIP & LIMITATION OF LIABILITY
Participation in the WORKEARLY network does not create any relationship of exclusivity, employment, agency, partnership or representation between WORKEARLY and a Hiring Partner, unless expressly agreed otherwise in writing.
WORKEARLY is not responsible for the accuracy, completeness or quality of information or CVs provided by candidates, nor does WORKEARLY guarantee the suitability of any candidate for a particular role.
Unless expressly agreed otherwise, WORKEARLY is not responsible for the recruitment decisions of Hiring Partners or for the employment or other professional relationship that may subsequently arise between a Hiring Partner and a candidate.
HIRING PARTNER OBLIGATIONS
Hiring Partners must:
use CVs and other candidate information received through WORKEARLY solely for legitimate recruitment and candidate evaluation purposes and not for unrelated purposes, including advertising, marketing or the sale of candidate data;
comply with applicable equal treatment and non-discrimination requirements in connection with their recruitment activities;
maintain fair and transparent recruitment practices; and
comply with applicable data protection and privacy laws in relation to any personal data received or otherwise processed in connection with candidates.
Once candidate personal data has been provided to a Hiring Partner, the Hiring Partner is responsible for its own subsequent processing of that data in accordance with applicable data protection law.
TERMINATION OF PARTICIPATION
WORKEARLY may suspend or terminate a Hiring Partner’s participation in the WORKEARLY network, including its access to relevant WORKEARLY network features or services, where applicable.
Following termination, WORKEARLY may remove the Hiring Partner’s profile, name, logo and job opportunities from the WORKEARLY Website and relevant services.
Termination does not affect any obligations relating to candidate personal data already received by the Hiring Partner, which must continue to be processed in accordance with applicable data protection law.
PART C — WORKEARLY TALENT POOL
The WORKEARLY Talent Pool enables individuals interested in professional opportunities (each a “Candidate”) to create a professional profile and express their interest in employment opportunities that may be made available through WORKEARLY or participating companies.
Participation in the WORKEARLY Talent Pool does not create an employment relationship with WORKEARLY or any Hiring Partner and does not constitute a promise or guarantee of employment, interviews, job offers or any other professional outcome.
CANDIDATE PROFILES
Candidates may create a profile containing information relating to their professional background, qualifications, skills, experience and other information relevant to potential employment opportunities.
Candidates must ensure that the information they provide is accurate, truthful and up to date. WORKEARLY is not required to independently verify the accuracy or completeness of information provided by Candidates.
Candidate information may be made available or shared with Hiring Partners or other potential employers in accordance with the functionality of the relevant service, these Network Terms and WORKEARLY’s applicable privacy information.
ROLE OF WORKEARLY
WORKEARLY facilitates connections and communication between Candidates and Hiring Partners or other potential employers.
WORKEARLY does not act as the employer of Candidates or as their agent or representative. Unless expressly agreed otherwise for a particular service, WORKEARLY does not make recruitment decisions on behalf of Hiring Partners or other employers.
Decisions concerning candidate assessment, interviews, job offers, recruitment and the terms of any subsequent employment or professional relationship are made exclusively by the relevant employer.
THIRD-PARTY JOB OPPORTUNITIES
WORKEARLY may publish, promote or otherwise make available job opportunities provided by third-party employers or other providers and may direct Candidates to third-party websites or services in connection with those opportunities.
Job descriptions, eligibility requirements, application procedures and other information relating to third-party job opportunities are determined and provided by the relevant employer or job listing provider. WORKEARLY does not guarantee the accuracy, completeness, continued availability or duration of such job opportunities or related information.
Where a Candidate is redirected to a third-party website or service to submit an application or access a related service, use of that website or service is subject to the relevant third party’s own terms and conditions, privacy policy and other applicable policies.
WORKEARLY is not a party to any employment or other professional relationship that may arise between a Candidate and an employer and is not responsible for the recruitment process, interviews, hiring decisions, terms of employment, remuneration or other aspects of that relationship.
Where use of a third-party service or submission of an application requires a payment, subscription or other charge, the relevant transaction is exclusively between the Candidate and the third-party provider. WORKEARLY is not a party to that transaction and is not responsible for payments, charges, refunds or other financial disputes relating to such third-party services.
PROFILE, CONTENT & JOB LISTING REMOVAL
WORKEARLY may suspend, restrict or remove Candidate profiles that contain inaccurate or misleading information, breach these Network Terms or other applicable WORKEARLY terms, infringe third-party rights or may cause harm to WORKEARLY, its Users or participating companies.
Participation in the WORKEARLY Talent Pool may be terminated at any time by either the Candidate or WORKEARLY, subject to any rights or obligations arising under applicable law.
WORKEARLY may also remove, restrict or disable access to profiles, CVs, job listings or other content made available through the WORKEARLY Talent Pool where WORKEARLY reasonably considers that such content breaches applicable law, these Network Terms or other applicable WORKEARLY terms, infringes third-party rights or may cause harm to Users, participating companies or WORKEARLY.
WORKEARLY may remove or discontinue the publication of any job listing where it reasonably considers that the listing breaches applicable law, these Network Terms or other applicable WORKEARLY terms, or infringes third-party rights.
Users may report job listings, profiles, content or activities that they consider unlawful, misleading or contrary to these Network Terms by contacting support@workearly.com. WORKEARLY may review such reports and take any action it considers appropriate in the circumstances.
